Terms of Service

1. Subject of the Agreement
These Terms of Service govern the use of the WGprime platform, a service of Saatwika UG (haftungsbeschränkt). WGprime provides an online marketplace and AI-assisted search tool for student housing in Germany.
2. Eligibility and Registration
- Target Audience: Our booking services are primarily intended for students enrolled in or applying to German academic institutions.
- Account Accuracy: Users must provide truthful information regarding their identity, university status, and financial capability.
- Age Requirement: Users must be at least 18 years of age.
3. Platform Services
3.1 Housing Search & Listings
- We provide tools to filter and search for student housing based on location, price, amenities, and other criteria.
- Waitlist: Registration for a waitlist does not guarantee a room offer. Room allocation is at our discretion.
- No Guarantee: We do not guarantee the accuracy, completeness, or availability of room listings. Property information is provided by landlords and third parties.
3.2 AI Chatbot - No Warranty
We provide an AI chatbot to help you search for rooms.
"AS-IS" Service: AI responses are provided WITHOUT any warranty. The AI may provide incorrect, incomplete, or misleading information.
YOU MUST VERIFY: Always verify AI suggestions against official room listings on our website. Do NOT rely solely on AI chatbot responses for booking decisions.
No Liability: We are NOT responsible for any decisions you make based on AI recommendations or any financial losses from following AI advice.
Third-Party Processing: Your chat messages are processed by a USA-based third-party AI provider. You can use our manual search filters instead to avoid AI processing.
4. Bookings and Payments
- Stripe Integration: All financial transactions (rent, security deposits) are processed securely through Stripe.
- Booking Confirmation: A booking is considered binding only after successful payment and receipt of a confirmation notice from WGprime.
- Booking Expiry: Unpaid bookings expire automatically after 15 minutes. The room/bed will be released and made available to other students.
- Cancellation: Cancellation and refund policies vary by property. Generally: Full refund if canceled 30+ days before move-in, 50% refund if 15-30 days before, no refund if less than 15 days before move-in. Specific terms will be stated in your rental contract.
5. User Obligations
- Users agree to use the platform in good faith.
- Submission of fraudulent documents or information is strictly prohibited and will lead to immediate account termination.
6. Limitation of Liability
German Law: We are liable for damages caused by intent or gross negligence. For slight negligence, liability is limited to breach of essential contractual obligations.
Third-Party Services: We are NOT responsible for failures, errors, or outages caused by third-party service providers (payment processors, AI services, email providers, hosting services, etc.).
Inaccurate Information: We are NOT responsible for inaccurate or incomplete information provided by landlords, AI chatbot errors, or changes to property availability.
Data Loss: We implement industry-standard security measures (HTTPS, password hashing, secure database access). However, we cannot guarantee against all data loss scenarios (hardware failures, cyberattacks, force majeure, etc.). You must maintain your own backups of important booking confirmations and contracts.
Liability Cap: Our total liability is limited to the lower of:
- Total amount you paid in the last 12 months, OR
- €1,000
Exceptions: Nothing limits our liability for death, personal injury, fraud, or other liability that cannot be excluded by German law.
7. Governing Law
These terms are governed by the laws of the Federal Republic of Germany. The place of jurisdiction is the registered seat of Saatwika UG, provided the user is a merchant or has no general place of jurisdiction in Germany.
