1. Subject of the Agreement
These Terms of Service govern the use of the WGprime platform, operated by Ebru Tuncer Singh.
Important: We Are an Intermediary Platform
WGprime operates solely as an online platform connecting international tenants with independent landlords. We provide:
- An online marketplace to search for rental housing
- AI-assisted search tools and booking system
- General support and guidance for settling in Germany
We do NOT own, operate, manage, inspect, or control any properties listed on our platform. All properties are owned and managed by independent third-party landlords.
2. Eligibility and Registration
- Target Audience: Our booking services are primarily intended for tenants, including students, working professionals, and families seeking housing in Germany.
- Account Accuracy: Users must provide truthful information regarding their identity, university status, and financial capability.
- Age Requirement: Users must be at least 18 years of age.
3. Platform Services
3.1 Housing Search & Listings
- We provide tools to filter and search for rental housing based on location, price, amenities, and other criteria.
- Waitlist: Registration for a waitlist does not guarantee a room offer. Room allocation is at our discretion.
- No Guarantee: We do not guarantee the accuracy, completeness, or availability of room listings. Property information is provided by landlords and third parties.
3.2 AI Chatbot - No Warranty
We provide an AI chatbot to help you search for rooms.
"AS-IS" Service: AI responses are provided WITHOUT any warranty. The AI may provide incorrect, incomplete, or misleading information.
YOU MUST VERIFY: Always verify AI suggestions against official room listings on our website. Do NOT rely solely on AI chatbot responses for booking decisions.
No Liability: We are NOT responsible for any decisions you make based on AI recommendations or any financial losses from following AI advice.
Third-Party Processing: Your chat messages are processed by a USA-based third-party AI provider. You can use our manual search filters instead to avoid AI processing.
4. Bookings and Payments
- Stripe Integration: All financial transactions (first month rent, one-time documentation fee) are processed securely through Stripe.
- Booking Confirmation: A booking is considered binding only after successful payment and receipt of a confirmation notice from WGprime.
- Booking Expiry: Unpaid bookings expire automatically after 5 minutes. The room/bed will be released and made available to other tenants.
- Cancellation: Cancellation and refund policies vary by property. Generally: Full refund if canceled 30+ days before move-in, 50% refund if 15-30 days before, no refund if less than 15 days before move-in. Specific terms will be stated in your rental contract.
5. User Obligations
- Users agree to use the platform in good faith.
- Submission of fraudulent documents or information is strictly prohibited and will lead to immediate account termination.
6. Limitation of Liability
Important: We Are NOT Property Owners
WGprime operates as a trusted bridge connecting international tenants with independent landlords. We provide support services to help tenants settle in Germany. We do NOT own, operate, control, inspect, or manage any properties listed on our platform.
Property Owner Responsibility: All property-related matters are the SOLE responsibility of the landlord/property owner, including:
- Building safety, fire safety, and structural integrity
- Maintenance, repairs, and equipment functionality
- Compliance with housing regulations and safety standards
- ANY injuries, accidents, or health issues occurring on the premises
- Property defects, hazards, or dangerous conditions
Our Services (What We Provide):
- Platform connecting tenants with verified housing opportunities
- Booking system and payment processing
- General guidance on visa requirements and registration (Anmeldung)
- Support with administrative processes for settling in Germany
- Protecting your personal data (GDPR compliance)
Guidance Services: Our visa, registration, and administrative advice is provided as general guidance based on our personal experience. We are NOT lawyers, immigration consultants, or government officials. You should verify all information with official authorities (Ausländerbehörde, Bürgeramt, etc.).
Platform Liability Cap: For our platform and support services, our total liability is limited to your most recent payment to WGprime, up to a maximum of €500.
What We Are NOT Liable For:
- ANY property-related injuries, accidents, or health issues on the premises
- Building safety issues, structural defects, or equipment failures
- Landlord disputes, contract breaches, or refund issues with property owners
- Government decisions (visa rejections, registration delays, permit denials)
- Third-party service failures (Stripe payment processor, email, hosting, AI services)
- Inaccurate information provided by landlords about properties
- AI chatbot errors or incomplete suggestions
Your Recourse: For property safety issues, contact the landlord directly. For serious issues, contact local authorities or tenant protection services (Mieterschutzbund).
Mandatory Exception: This limitation does not apply to damages directly caused by our own intentional fraud or gross negligence in operating our platform services, as required by German law.
7. Governing Law
These terms are governed by the laws of the Federal Republic of Germany. The place of jurisdiction is NĂĽrnberg, Germany, provided the user is a merchant or has no general place of jurisdiction in Germany.
